Euro court rules out web filter
The city -- The Ecu Court of Justice has ruled that online sites companies can't be forced legally to set up blocking systems that prevent illegal file downloads. Decision, passed down Thursday, pertains to music piracy in Belgium, and can apply over the Eu. In 2004, Belgian privileges management organization SABAM acquired an injunction needing the organization Scarlet Extended to prevent its clients swapping files that contains music within the SABAM repertoire. Scarlet become a huge hit, and also the Belgian court requested the ecu Court of Justice for advice. Its ruling concludes that, to be able to remove the problem files, the Web service provider would need to monitor all its customers' electronic communication. This type of general monitoring obligation is incompatible with European law. Additionally, it ruled the injunction unsuccessful to respect the essential privileges of clients as well as the Web service provider. Needing Scarlet to set up an elaborate, pricey, permanent computer at its very own expense will be a serious violation from the company's freedom to conduct its business, it stated.
